Why are gas safety inspections necessary?

The amended Residential Tenancy Act (1997) became effective on March 29, 2021, with approximately 130 additional guidelines. For Victorian landlords, this meant a huge rise in responsibilities and compliance obligations. A gas safety assessment by a competent Type A gasfitter is required every two years in Victoria for rental premises.

Carbon monoxide is poisonous, odourless, and lethal. For the safety of the occupants, any installation that is leaking carbon monoxide must be immediately capped off.

Ongoing gas safety checks

Rental providers who enter into a new agreement after March 29, 2021, or who have a fixed-term agreement with a term of more than five years that rolls over into a periodic tenancy after March 29, 2021, must:

  • Have a licensed or certified gasfitter do gas safety checks every two years.
  • Ensure that a gas safety check has been performed within the last two years before the renter moves in (and if it hasn’t, the rental company must schedule one as soon as feasible).
  • Keep track of the safety inspection and be prepared to provide specifics if the renter inquires.
  • Declare the date of the most recent gas safety inspection, as well as any outstanding safety inspection recommendations, before signing a rental agreement.

Locating a certified gas fitter

  • A registered or licensed gasfitter is a plumber who is registered or licensed with the Victorian Building Authority (VBA) to perform gasfitting work.
  • Only gasfitters who are currently registered or licensed to perform specialised Type A appliance servicing work are permitted to do so.
  • A licensed or registered gasfitter can be found by searching online or using a directory such as the Yellow Pages.
  • On the VBA website, you can determine whether a gasfitter is registered or licensed to perform Type A appliance servicing work.
  • You can also request to see the plumber’s card, which shows that they are currently registered or licensed to perform Type A appliance servicing work.
  • You should request to see the card indicating that the plumber is currently registered or licensed to perform Type A appliance servicing work, indicating that they are qualified to perform gasfitting servicing work.

Note: Registered plumbers performing specialised plumbing work must do so under the supervision of a specialised class licensee.

What the gas safety inspection includes (from a technical perspective)

A gas safety check entails the following:

A – The gas installation checks as listed below:

  1. That LPG cylinders and related gas components are properly placed.
  2. That where required by AS/NZS 5601.1 “Gas installations”, as published or revised from time to time, appliance gas isolation valves are installed.
  3. That gas appliances and their components may be serviced and adjusted easily.
  4. That the gas installation is safe to use electrically.
  5. Ensure appliance clearances to flammable surfaces comply with installation instructions and AS/NZS5601.1 “Gas installations,” as published or updated from time to time.
  6. That there is sufficient ventilation to allow appliances to function safely.
  7. That gas appliances (including ovens) are properly secured against tipping.
  8. Inspecting the flue systems of gas appliances, especially chimneys.
  9. Checking for documentation of certification on gas equipment.

B – Checking for leaks in gas installations.

C – All type a gas appliances that are part of a normal gas installation should be serviced.

Note: See regulation 12(4) of the Gas Safety (Gas Installation) Regulations 2018, which establishes a standard for maintenance work on a Type A gas appliance that is part of a standard gas installation under section 72 of the Gas Safety Act 1997. Section 72 of the Gas Safety Act 1997 mandates that anyone doing gasfitting work ensures that the work meets the criteria and conditions outlined in the Act.

Proof of a gas safety check

A record of the gas safety check should be provided by the gasfitter. The following items must be included in the document:

  1. The gasfitter’s full name and business information, including his or her license or registration number
  2. The date on which the safety inspection was performed
  3. The check’s findings, including any required servicing and repairs, as well as the activities are taken to address the problem
  4. For each Type-A gas appliance that is serviced as part of the standard gas installation, a copy of the record of gas servicing work is filed to the VBA and delivered to the rental provider under the Gas Safety (Gas Installation) Regulations 2018 is required.

Keep a record of your gas safety check

Your gas safety check record can be one of the following:

  • a certificate of compliance (if applicable)
  • a certificate from the licensed gas fitter who performed the safety check

You must maintain the compliance certificate or tax invoice for any further gas work done after the examination is completed.

Until the next safety check is documented, you must maintain the records, including the license or registration number of the licensed or registered gasfitter.

The rental company must give a copy of the most recent gas safety check within seven days after receiving a written request from the tenant.

Gas safety inspections for newly constructed homes

A separate gas check may not be necessary if the rented premises is a newly constructed house or apartment. The term “newly built home” refers to a residence that has never been occupied.

Checks for gas safety

A filed compliance certificate certifies that the work complies with plumbing regulations. A compliance certificate validating a gas installation certifies that the installation complies with AS/NZS 5601.1.

This means that the compliance certificate given for gas installations (which applies to all gas installations stated on the compliance certificate on the premises) will meet the requirements of a gas safety inspection for the new rental legislation.
